New York Mortgage Recording Tax (MRT)

The New York Mortgage Recording Tax is imposed on the recording of a mortgage on real property in New York State. It is one of the largest buyer closing costs and has no equivalent in most other states.

Reviewing it carefully — and comparing Loan Estimates from multiple lenders — is the most important step in managing closing costs. You’ll receive a final Closing Disclosure at least 3 business days before closing with actual, final figures.
Can the seller pay the mortgage recording tax in New York?
The mortgage recording tax is by custom and law the buyer’s responsibility in New York — it is not typically negotiated to the seller. However, a seller can agree to pay buyer closing costs as a concession, which could effectively offset the MRT cost. This must be structured carefully in the purchase contract, and the lender must approve any seller concession. The MRT itself is still paid by the buyer at recording but the net effect can be similar if the seller provides an equivalent credit.
Does the mansion tax apply to all New York purchases over $1 million?
The mansion tax applies to purchases of residential real property in New York State for $1,000,000 or more. It applies statewide — not just in New York City — which means a $1,100,000 purchase in Westchester, the Hudson Valley, or Long Island is subject to the mansion tax. The 1% base rate on $1–2 million purchases is the most common tier. At $1 million exactly, the tax is $10,000.
