West Virginia Closing Costs Guide 2026
West Virginia’s statewide recording fees, the real estate transfer excise tax and who pays it, how title insurance rates are filed, how the closing process runs, and a fee-by-fee breakdown for West Virginia buyers and sellers.
Buyer Closing Costs in West Virginia
West Virginia fixes its county clerk recording fees in state law, so they are the same in every county. The rest of a buyer’s closing costs are set by the lender, appraiser, title company and closing agent, which is why comparing Loan Estimates line by line matters.
| Cost | Amount | Who Sets It |
|---|---|---|
| Recording the deed of trust | $30.00 | W. Va. Code § 59-1-10 — identical in all 55 counties |
| Each page over five pages | $1.00 | Same statute |
| Lender origination and underwriting | Set by the lender | Compare on the Loan Estimate |
| Appraisal | Set by the appraiser | Ordered through your lender |
| Title insurance and search | Set by the title insurer | Ask for quotes on both policies |
| Settlement or closing fee | Set by the closing agent | Ask for it in writing |
| Prepaid property taxes and insurance | Depends on closing date | Escrow set-up |
West Virginia’s estimated effective property tax rate is 0.53%, so the prepaid tax and escrow reserve lines scale with the price of the home.
West Virginia Seller Closing Costs
Sellers pay a different set of charges. In West Virginia they include the transfer excise tax, which the grantor pays unless the buyer accepts the deed without it having been paid.
| Cost | Amount | Notes |
|---|---|---|
| Transfer excise tax | $1.65 to $2.75 per $500 of value | W. Va. Code § 11-22-2 — see below |
| Affordable Housing Fund fee | $20.00 | On each transfer of real estate for consideration |
| Recording the deed | $30.00 | W. Va. Code § 59-1-10 |
| Real estate commission | Negotiated | Agreed in the listing agreement |
| Mortgage payoff | Payoff amount | Paid from the sale proceeds |
| Property tax proration | Depends on closing date | Seller covers their share of the year |
West Virginia Real Estate Transfer Tax
W. Va. Code § 11-22-2 imposes an excise tax on the privilege of transferring title to real estate, in two parts. The first is $1.10 for each $500 of value; since July 1, 2025 it has been retained by the county where it is collected. The second is an additional county tax of 55 cents for each $500, which a county commission may raise by majority vote to as much as $1.65. The combined rate is therefore $1.65 to $2.75 per $500. A separate $20 fee on each transfer for consideration goes to the state’s Affordable Housing Fund.
| Sale Price | At $1.65 per $500 | At $2.75 per $500 |
|---|---|---|
| $150,000 | $495 | $825 |
| $200,000 | $660 | $1,100 |
| $250,000 | $825 | $1,375 |
| $300,000 | $990 | $1,650 |
| $350,000 | $1,155 | $1,925 |
These are calculations from the statutory rates, not quotes, and they exclude the $20 Affordable Housing Fund fee. Ask the county clerk where the property sits which county rate applies. The tax is paid by the grantor unless the grantee accepts the deed without it having been paid, in which case the grantee pays.
Title Insurance in West Virginia
A lender will require a lender’s title policy; an owner’s policy protects the buyer’s own equity. West Virginia title insurers file their rates with the West Virginia Offices of the Insurance Commissioner, and an insurer may deviate from a rating organization’s filing with the Commissioner’s permission, so premiums can differ between companies. Ask for quotes on both policies before closing.
| Policy Type | Who Pays (Customary, Negotiable) | Purpose |
|---|---|---|
| Lender’s policy | Buyer | Protects the lender’s interest up to the loan amount |
| Owner’s policy | Negotiated in the purchase contract | Protects the buyer’s equity in the property |
| Endorsements | Varies | Cover specific risks such as survey or zoning matters |
The West Virginia Closing Process
A West Virginia closing ends with the deed and deed of trust recorded by the clerk of the county commission, under the statewide fee schedule, with the transfer tax paid at the time of recording.
| Stage | What Happens |
|---|---|
| Offer accepted | Purchase agreement signed; earnest money deposited |
| Loan application | Lender issues a Loan Estimate |
| Title search | Title company examines the chain of title and issues a commitment |
| Appraisal and underwriting | Value confirmed; conditions cleared |
| Closing Disclosure | Final figures issued before closing |
| Closing and recording | Documents signed, funds disbursed, transfer tax paid, deed and deed of trust recorded |
How to Reduce Your West Virginia Closing Costs
The recording fees and transfer tax are fixed by statute, but most of a West Virginia closing is negotiable or shoppable.
- Compare lenders. Origination, underwriting and processing fees vary between lenders, and the Loan Estimate exists so you can put them side by side. This is where working with an experienced Brokered Mortgage Advisor can help you save time and money throughout your transaction, by shopping rates and costs with several different lenders before your loan package is submitted.
- Shop title and closing services. Title premiums are filed insurer by insurer, so ask more than one title company for its premiums and settlement fee.
- Ask for seller concessions. Sellers can contribute toward buyer closing costs within your loan program’s limits — VA, for example, caps seller concessions at 4% of reasonable value but does not limit seller credits for closing costs.
- Consider WVHDF assistance. The Low Down Home Loan can cover up to $12,000 of down payment and closing costs with a WVHDF first mortgage.
- Check the page count. Recording documents over five pages adds $1 for each extra page.
